Terms of Service

Your account

You are responsible for your account, API keys, and activity performed using them. Please keep your credentials secure and let us know if you believe your account has been compromised.

You must be at least 13 years old to use release.garden.

Your content

You keep ownership of the software, files, release notes, and other content you upload to release.garden.

You give Waysider permission to store, copy, process, and distribute your content as necessary to operate release.garden and provide the features you request. This permission ends when your content is deleted, except where temporary copies remain in backups.

You are responsible for what you upload. You must have the rights necessary to publish and distribute it.

Acceptable use

Do not use release.garden to:

• distribute malware or other intentionally harmful software;
• distribute content you do not have the right to distribute;
• violate the law or the rights of others;
• attack, disrupt, or abuse release.garden or other systems; or
• use the service in a way that creates unreasonable technical or operational problems for us or other users.

We may remove content or suspend or terminate accounts when reasonably necessary to enforce these rules, protect the service or others, or comply with the law.

Public releases

Content published through a public project is available to anyone and may be downloaded, cached, or redistributed by others.

If you remove public content from release.garden, copies downloaded or cached by others may continue to exist outside our control.

Payments

Some release.garden features may require payment. Prices and applicable limits are shown when you purchase a plan.

Subscriptions renew until canceled. You can cancel at any time, and cancellation takes effect at the end of your current billing period unless we tell you otherwise.

We may change our prices or paid plans. If a change affects an existing subscription, we will provide reasonable notice before it takes effect.

The service

We work to keep release.garden reliable, but we cannot guarantee that it will always be available, uninterrupted, or error-free.

We may change or discontinue features as the service evolves. If we discontinue release.garden entirely, we will make reasonable efforts to give users advance notice and an opportunity to retrieve their content.

Termination

You may stop using release.garden or delete your account at any time.

We may suspend or terminate access when you violate these terms, create a security or abuse risk, fail to pay amounts owed, or when we are legally required to do so.

Account deletion also deletes your projects and releases, subject to temporary backups and information we are required or permitted to retain.

Disclaimers

release.garden is provided "as is" and "as available." To the extent permitted by law, Waysider disclaims warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You are responsible for maintaining appropriate copies or backups of software and other content you publish through release.garden.

Limitation of liability

To the extent permitted by law, Waysider will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from your use of release.garden.

Our total liability for claims relating to release.garden will not exceed the greater of $100 or the amount you paid us during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules.

Changes to these terms

We may update these terms as release.garden changes. If we make material changes, we will provide reasonable notice. Continuing to use release.garden after the updated terms take effect means you accept them.
